What steps are required for the constitutionalization of a Commission? Do you think granting constitutional status to the Central Information Commission (CIC) would strengthen the RTI regime in India? Give reasons.
Main Body
Central Information Commission is a Statutory Body established by Act of Parliament. [Mandates] → [Pushes information implementation of RTI] hold investigations → ensure better government transparency [Steps for Constitutionalization of a Commission] (1) Presentation of the Bill by the Member of the Parliament in LS or RS (Art 360) (2) Passed by one House by Special Majority - 2/3rd present & voting + 1/2 of total House. (3) Pass to other House, similar procedure
is followed in other House. (4) Bill goes to the President: President (has to give assent.) (5) New article is Added and the Commission becomes a Constitutional Body. [Current challenges of CIC as Statutory body] With complex diagram showing: [Recommendation Nature] → [Appointment by Salary etc! Less powers] → [Change as independent Body] [Lack powers] → [Legislative determined Competence] (1) Ensure Independence of the Commission. → Security of Tenure, Salary charged on Constitution fixed & etc. (2) Give them powers of Civil Court → Impersive better investigation of charges. (3) Have more Independence in pursuing voluntary publication of Details → Rajasthan Jam sorcche Detail. (4) Complement [Article 19] → ensuring more freedom and Right to know.
Thus a constitutional status could give better opportunity to CIC to implement RTI. But, need to be followed in letter of spirit of essence of the Commission Assailed by the officers → AFC → TIP → Responsiveness. [Constitutional Status could strengthen RTI regime]
